1. Conditions.

Hydro Host is a trading name of Hydro Host LTD. By purchasing any of our services you agree to be bound to these terms and conditions. These terms and conditions apply to all Hydro Host accounts, hosting accounts, domains and other products. They set out the basis on which we offer our services. By accepting them you agree you have read them carefully and agree with them.

2. Services

2.1 Hydro Host will make all reasonable efforts to supply a continuous service at a high quality and to the description of each product at the time of purchase. Hydro Host is not, however, liable for any loss or damage resulting from a service outage outside of our control. Hydro Host is not liable for any loss of business, service or data which is outside of our control. Hydro Host is not responsible for any losses suffered resulting from acts of god or force majeure including civil unrest, riots, floods, drought, fire, war and imposing legislation.

2.2 Hydro Host is not liable for any loss of business, contracts, profit, savings or otherwise.

2.3 Hydro Host is unable to control any data sent over the internet and is not liable for any data which may be inaccurate, misleading, offensive, threatening or obscene material that is in breach of UK, International, or other applicable law; responsibility resides with the customer for all information transmitted by themselves.

2.4 From time to time Hydro Host or it's sub-contractors carry out maintenance on parts or all of the network. Such work may require us to temporarily close down some or all of the systems. In such cases we will give as much notice as possible and shall keep all disruption to a minimum. Hydro Host accepts no liability arising from such suspension of service. Such notified downtime is excluded from the 99.9% uptime money back guarantee.

2.5 The customer agrees that it will not re-sell, sub-lease, reassign or transfer any part of Hydro Host's services without prior written permission, this excludes reseller accounts held with us.

2.6 24/7 Support uners to Help Desk submissions and Knowledge base queries. Actual time of response may vary.

2.7 A valid domain name must be linked to all web hosting accounts within 5 days of signup.

2.8 Affiliate programme commissions are as detailed at http://hydro-host.net/affiliates and may change at any time without prior warning or notification. Our affiliate programme may be cancelled at any time without prior warning or notification.

2.9 Affiliate programme withdrawals are subject to a minimum payout of £25.00 GBP.

3. Banned Content

3.1 Customers must use Hydro Host Services for lawful and authorised purposes only. Storage, presentation or transmission of copyrighted material is strictly prohibited.

3.2 Storage, presentation or transmission of data, information or work which violates British, UK, International or other applicable laws is strictly prohibited.

3.3 Distribution or storage of malicious scripts or programs such as viruses is strictly prohibited.

3.4 Content which intends to teach or endorse malicious scripts or hacking is also prohibited.

3.5 Phishing or similar activities are strictly forbidden

3.6 The hosting of BitTorrent files and/or BitTorrent Trackers linking to or enabling the transmission of materials protected by copyright whether contained on or away from our network is strictly forbidden.

3.7 The hosting of proxies or similar services is strictly forbidden.

3.8 We reserve the right to immediately and without notice terminate the services of customers who violate the conditions in either (and/or) 3.1, 3.2, 3.3, 3.4, 3.5, 3.6., 3.7

4. Domains

4.1 Domains are issued under the terms and conditions of enom who's terms and conditions can be found at: http://www.enom.com/terms/default.asp

4.2 Domains excluded from any money back guarantee and are not eligible for refunds.

4.3 By registering a domain name with Hydro Host you agree to the terms and conditions set out by enom.

5. Bandwidth

5.1 Bandwidth on all accounts is constantly monitored. Any account exceeding their bandwidth quota will be automatically suspended until more bandwidth quota has been purchased or until the next calendar month.

5.2 Hydro Host accepts no liability whatsoever for any loss of business, clients or profits, or any other liability caused by exceeded bandwidth.

6. Adult Content

6.1 We allow lawful adult content on our services.

6.2 Pornographic or sexually-explicit images of children is strictly prohibited.

6.3 Pictures, video or other content which has been obtained illegally is prohibited on our services.

7. Servers and Resources

7.1 Attempts to abuse, cause harm or undermine our servers will result in immediate termination of services.

7.2 Hydro Host takes no responsibility or liability for the use of our client's accounts.

7.3 Hydro Host reserves the right to remove any application, software, program, feature or service from our hosting services at our own discretion without prior notice.

8. Staff Abuse

8.1 If you are in any way disrespectful towards any member of Hydro Host staff we reserve the right the immediately terminate all services without notice or refund.

8.2 If you are in any way disrespectful towards any member of GBI Design staff we reserve the right the immediately terminate all services without notice or refund.

9. SPAM and Unsolicited commercial e-mail

9.1 You agree and understand that transmission of SPAM e-mails or other unsolicited commercial e-mails from our servers using e-mail addresses maintained by us is STRICTLY prohibited. Any account found violating this clause with be terminated immediately without prior notice or refund. Hydro Host would be the sole arbiter as to what constitutes a violation of the clause.

9.2 You agree and understand that you may not send more than 100 emails in one hour (per domain). Customers cannot/should not send more than this specified number of emails in one hour irrespective of the size of their mailing lists.

9.3 Customers are required to immediately remove any bouncing email addresses from their mailing lists.

9.4 All mailing lists should operate a double opt in system for subscription to any list and should provide obvious and functional means to unsubscribe.

10 Backups

10.1 Hydro Host will use reasonable efforts to protect and backup data for clients on a regular basis. Hydro Host cannot however, guarantee the existence, accuracy or regularity of backup services.

10.2 The customer has the sole responsibility for making back-up files that are in connection with our services. Hydro Host is not liable for any loss or damage to data contained on our services.

11. Security

11.1 Your account password gives access to your account. It is your responsibility to ensure your password is kept safe at all times.

11.2 Attempting to gain access to any other user's account is strictly prohibited.

11.3 Storage or transmission of malicious scripts and programs is strictly prohibited on our services.

12. Cancellations, Refunds and Money Back Guarantees

12.1 Hydro Host reserves the right to suspend or terminate services on receipt of abuse complaints. No notice or refunds will be offered.

12.2 All Hosing packages come with a 30 day money back guarantee. Domain name registration is excluded from this offer. Customers who pay monthly will only receive a 15 day money back guarantee.

12.3 Where free domain name registration has been offered as part of your hosting services £7.99 will be deducted from any refund.

12.4 Only first time accounts are eligible for a refund. If you have already had an account with us in the past you will not be eligible for a refund.

12.5 Custom packages and plans are not eligible for refund or money back guarantee.

12.6 Scheduled and notified service interruptions will not count towards the uptime guarantee.

12.7 Hydro Host offer a 99.9% uptime guarantee, which is worked out on a 1 month basis. If uptime falls below 99.9% in the calendar month a refund for that month will be offered. Refunds may be processed by either the original payment method, or by way of Hydro Host credit, this is at the discretion of the client.

12.8 To qualify for our uptime guarantee refund you must submit a support ticket after each interruption of service OR be able to prove the amount of downtime.

12.9 All claims against this uptime guarantee should be submitted in the form of a support ticket.

13. Termination of Service

13.1 Hydro Host reserves the right to suspend or terminate services for any reason at our sole discretion upon giving 14 days written notice to you.

13.2 Hydro Host reserves the right to suspend or terminate any services immediately and without warning should any of these terms and conditions be breached.

13.3 Hydro Host reserves the right to suspend or terminate any services immediately and without warning for late or non-payment of monies due.

13.4 Termination of services involves all data relating to the terminated account being removed from our servers. You have the sole responsibility of backing-up data.

14. Modification of Terms

14.1 Hydro Host reserves the right to modify these terms and conditions at any time without notice. All customers are bound to the latest terms and conditions which are published on this website.

15. Upstream providers and enom

15.1 By accepting these conditions you accept the conditions of our upstream providers. Details of these conditions may requested by contacting our support or sales.

17. Law

17.1 This Agreement will be governed by and construed and interpreted in accordance with the law of England and Wales and the parties submit to the exclusive jurisdiction of the English Courts.

17.2 The Customer and Hydro Host both agree that a court may strike out or override any part of these terms and conditions if it considers them to be illegal, unenforceable or unfair and in such cases enforce only the terms and conditions as if the offending clause or clauses had never been contained in them.
